Several news outlets in Memphis reported that a shooting took place at Billy Hardwick’s All-Star Lanes at White Station and Quince on Tuesday, January 31, 2017, about 11:30 p.m. According to reports, as many as four people were injured during the shooting and the suspect is still at large.
Aside from the criminal charges likely to be filed, the shooting raises important legal and safety considerations for shopping centers and businesses around Memphis and Shelby County.
Under Tennessee law, a property owner is required to take reasonable safety measures to protect customers from the foreseeable criminal acts of third parties.
The level of safety precautions required will differ depending on a variety of factors, including the location, nature and use of the property, demographics of the area, and history of criminal activity in the area. All of these factors must be considered by a shopping center or other business owner when developing a safety and security plan for the premises.
A safety and security plan may include security guards, surveillance cameras, and site designs. It is not appropriate for shopping centers and business owners to use a one-size-fits-all approach to safety. Some locations may require more security measures, while others may require less.
If a shopping center does not provide adequate security for its customers and someone is injured as a result, then the injured customer may be able to bring a legal claim against the shopping center for inadequate security.
